Privacy Policy

Engrain Technology Inc., a Delaware Corporation, (“Engrain”, “we,” “us,” and “our”) respects the privacy of your personal information. We are committed to complying with this privacy policy (“Privacy Policy”), which describes what information we collect about you and others, including how we collect it, how we use and protect it, with whom we may share it and what choices you have regarding our use of your information.

This Privacy Policy applies to information collected on Engrain’s websites (collectively “Engrain.com”) which include Engrain.com, Support-Engrain.com, MyTouchTour.com, TouchTourCore.com, SightMap.com, UnitMap.com, and other related domains and subdomains thereof, as well as to our collection and use of information pursuant to our services offered on behalf of our property management customers. This Privacy Policy describes how Engrain.com uses and protects personal information collected by Engrain.

The term “personal information,” as used in this Privacy Policy, means information that relates to or is reasonably capable of being associated with an individual. 

Collecting Your Personal Information

We primarily collect personal information from two sources: (i) your use of the services that we provide on behalf of our property management customers and (ii) your use of Engrain.com.

Our Website

Certain visitors to Engrain.com choose to interact with Engrain.com in ways that require Engrain to gather personal information. The amount and type of information that Engrain.com gathers depends on the nature of the interaction. For example, we ask visitors who use our forums to provide a username and email address. Other information that you may provide or we otherwise may need to collect includes your first and last names, company name, mailing address, phone number, demographic information, and other commercial information. Engrain.com automatically collects information such as Internet Protocol (IP) addresses and other information about your devices or use of Engrain.com. Engrain.com does not use IP addresses to identify its visitors. In each case, Engrain collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Engrain.com. And visitors can generally refuse to supply personal information, with the caveat that it may prevent them from engaging in certain website-related activities. Like most website operators, Engrain collects information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Engrain’s purpose in collecting such deidentified information is to better understand how Engrain.com’s visitors use the website.

Additionally, we and our third-party providers may place files known as “cookies” on your device. Some cookies allow us and our third-party providers to store your preferences. Other cookies allow us and our third-party providers to passively gather certain information about your use of Engrain.com, which may include gathering information for the following purposes: statistics collection and analysis, optimization, analytics (as described below), and market research. We collect this information to improve the quality of your visit to Engrain.com, for security purposes, including for authentication, to facilitate website navigation and to personalize your experience while visiting Engrain.com.

Engrain.com may use Google Analytics, a web analysis service provided by Google, in order to better understand your use of Engrain.com and how we can improve it. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your personal information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to Engrain.com is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Google utilizes the data collected to track and examine the use of Engrain.com, to prepare reports on its activities and share them with other Google services. Some areas of Engrain.com may contain electronic images known as web beacons (sometimes known as clear gifs) that allow us and our third-party providers to count users who have visited certain portions of Engrain.com. You may opt out of certain cookies through the cookie preferences mechanism that we launch on Engrain.com

Our Services

We also collect information from end users of services that we offer on behalf of our property management customers. When you use our services, such as taking a virtual apartment tour, we may collect your personal information such as identifiers (e.g., your email address and other contact information). We may also collect information relating to your use of the services, although we do not link such information to your personal information.

Use of Personal Information

We use the information that we collect when you register with us, attend our events, receive newsletters, use certain other services, or participate in Engrain projects in any other way. We also use your information, including some personal information, to provide and improve our services.

We would like to send you email marketing communication which may be of interest to you from time to time. If you have consented to marketing, you may opt-out later. You have a right at any time to stop us from contacting you for marketing purposes. If you no longer wish to be contacted for marketing purposes, please click on the unsubscribe link at the bottom of the email.


Additionally, we may retain and use personal information to facilitate and otherwise address inquiries or requests regarding Engrain.com or our services, or respond to your questions or requests for information about or from us.  We may also use personal information as necessary to ensure compliance with any of our policies and any applicable legal requirements.

Sharing of Personal Information

Engrain.com may disclose personal information, such as email address or information about your use of our services, to those project administrators, employees, contractors, and affiliated organizations that need to know that information in order to process it on Engrain’s behalf or to provide services available through Engrain. Some of those employees, contractors and affiliated organizations may be located outside of your home country. Such third parties to whom we disclose personal information perform functions such as payment processing, operating and supporting Engrain.com, analyzing data, or performing marketing or consulting services.

From time to time, Engrain.com may release aggregate information, e.g., by publishing a report on trends in the usage of its website.

Engrain.com does not sell personal information to anyone.

Engrain also discloses personal information if required to do so by law, subpoena, or court order, if you give permission to have your information shared, or when Engrain believes in good faith that disclosure is reasonably necessary to protect the property or rights of Engrain, third parties, or the public at large. We may also disclose personal information to exercise our legal rights, or to take action regarding actual or suspected illegal or fraudulent activities or potential threats.

If you are a registered user of Engrain.com and have supplied your email address, Engrain may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Engrain.com and our products/services.

If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.

As we grow and develop our business, our corporate structure or organization might change, we may merge or otherwise combine with, or we or portions of our business might be acquired by, another company.  In any such transactions, personal information may be one of the transferred business assets.  Also, if any bankruptcy or reorganization proceeding is brought by or against us, your information may be considered a company asset that may be transferred to third parties.

Information Security

Engrain takes commercially reasonably measures to protect against the unauthorized access, use, alteration, or destruction of personal information. Nevertheless, no security system is impenetrable.  We cannot guarantee that information that users of Engrain.com or our services will be totally secure.  

Legal Grounds For Processing Personal Information. If applicable, we rely on one or more of the following legal bases of processing:
- Our legitimate interests in the effective delivery of information and services to you;
- Explicit consent that you have given;
- Performance of a contract; or
- Legal obligations.

Do Not Track

Certain state laws require that we indicate whether we honor “Do Not Track” settings in your browser.  We adhere to the standards set out in this Privacy Policy and do not monitor or follow any Do Not Track browser requests.

Visiting The System from Outside The United States

If you are visiting Engrain.com or using our services from outside of the United States, please be aware that your information may be transferred to, stored or processed in the United States, where our servers are located and our central database is operated.  The privacy, data protection and other laws of the United States and other countries might not be as comprehensive as those in your country.  By using any portion of Engrain.com or any of our other systems, you understand and consent to the transfer of your information to our facilities in the United States and those third parties with whom we share such information, as described in this Privacy Policy.

Access To Data

You have the right to request a copy of the information we hold about you. If you would like a copy of some or all your personal information, please follow the instructions at the end of this policy.

Retention Of Personal Information

We will retain your personal information on our systems only for as long as we need to, for the success of the programs that support Engrain. We keep contact information (such as mailing list information) until a user unsubscribes or requests that we delete that information from our live systems. If you choose to unsubscribe from a mailing list, we may keep certain limited information about you so that we may honor your request.

Engrain.com will not delete personal data from logs or records necessary to the operation, development, or archives of the Engrain.com projects.
When deletion is requested or otherwise required, we may anonymize the data of data subjects and/or remove their information from publicly accessible sites.

Rights In Relation to Your Information

Depending on your state and country of residence and subject to our discretion (in accordance with applicable law) you may have certain rights under data protection law in relation to the personal information we hold about you. In particular, you may have a right to:

- Request a copy of personal information we hold about you;
- Ask that we update the personal information we hold about you, or independently correct such personal information that you think is incorrect or incomplete;
- Ask that we delete personal information that we hold about you from live systems, or restrict the way in which we use such personal information (for information on deletion from archives, see the “Retention of personal information” section);
- Object to our processing of your personal information; and/or
- Withdraw your consent to our processing of your personal information (to the extent such processing is based on consent and consent is the only permissible basis for processing).
- If you would like to exercise these rights or understand if these rights apply to you, please contact dpo@engrain.com. We may ask you to provide personal information, including regarding your use of our services, in order to verify your identity.

We may also act as a “data process” for our business customers. You should therefore read the privacy notice for more information on how our customers (e.g., a property manager) use your information or to make choices about your personal information.

Third Party Links

Our website may contain links to other websites provided by third parties not under our control. When following a link and providing information to a third party website, please be aware that we are not responsible for the data provided to that third party. This Privacy Policy only applies to the websites listed at the beginning of this document, so when you visit other websites, even when you click on a link posted on Engrain.com, you should read their own privacy policies. We encourage you to seek out and read the privacy policy of each website that you visit and use.  

Job Applicants

Any personal information you provide us when applying for a career position with us will be used solely to consider and act upon your application.  We may retain your personal information for a period of time, but only for as long as necessary for such purposes.  We may also disclose your personal information to third parties hired by us to collect, maintain, and analyze candidates for career positions.

Children

Engrain.com is intended for a general audience and is not intended for use or view by children under 13 years of age, and we do not knowingly collect information about children or sell products to children.  Consistent with the Children’s Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13.

Privacy Policy Changes

Engrain.com may change its Privacy Policy from time to time, and at Engrain.com’s sole discretion. All updates to our Privacy Policy will be effective immediately upon notice thereof, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on Engrain.com.  Engrain.com encourages visitors to frequently check this page for any changes to its Privacy Policy.
